**Terms and Conditions** In these Membership Terms and Conditions, the following terms shall have the following meanings:

“Clarets Advantage”

means the official ticketed membership scheme operated by the Club which includes Platinum and Gold packages.

“Club”

means Burnley Football & Athletic Company Limited, a company registered in England and Wales with company number 00054222, whose registered office is situated at Turf Moor, Harry Potts Way, Burnley, Lancashire, BB10 4BX.

“Member”

means an individual who is registered as an official member of the Club’s Membership scheme and who is entitled to the Membership Benefits, subject to these terms and conditions.

“Membership”

means membership of the official membership scheme operated by the Club.

“Membership Benefits”

means the benefits listed in these terms and conditions or as otherwise notified to Members from time to time.

“Season”

means a football season, which generally starts on 1st July in one year and ends on 30th June in the following year.

How to Buy **1.** Memberships are provided and sold by the Club.** 2\. Memberships may be purchased by adults, either on their own behalf or on behalf of a child. See sections 13 and 14 below for more details. 3\. Memberships may be purchased online via the Club’s website (www.burnleyfootballclub/memberships). 4\. Once an order for a Membership has been placed online, and payment in full has been received by the Club, a contract will be formed between the purchaser and the Club to which these Membership Terms and Conditions will apply. By purchasing a Membership, you agree to be bound by, and comply with, these Membership Terms and Conditions. 5\. You have a legal right to change your mind about the purchase of the Membership. You must let the Club know within 14 days of the date on which you purchased the Membership (the “**Cooling-Off Period**”) if you wish to exercise this right by contacting us via the methods set out in section 27 below. You must return the Welcome Pack, and any other Membership Benefits you have received during the Cooling-Off Period, to the Club within 14 days of letting us know that you have changed your mind. You are responsible for any associated costs of return. You can return the Welcome Pack and any other Membership Benefits to the Club by post to Turf Moor, 52-56 Harry Potts Way, Burnley BB10 4BX. If you do this, you must keep a receipt or other evidence of postage that proves when you sent it. If you fail to do so, and the Club does not receive the Welcome Pack and/or other Membership Benefits, you will not receive a refund. 6\. Memberships may be purchased at any time during the 2024/25 Season. Certain Membership Benefits will only apply if you purchase a Membership before certain cut-off dates (see section 18 below for further details). 7\. You must provide complete and accurate information to the Club about the Member when applying for a Membership and you must notify the Club promptly if any of the Member’s details relevant to the Membership (including address, email address, telephone number and other contact details) change during the Season. 8\. Each Membership is valid for the 2024/2025 Season. Your Membership will automatically renew each Season unless you inform the Club by 1st June that you do not want your Membership to continue, in which case it will automatically terminate at the end of the initial term. The Club will contact you in May of each Season regarding payment for the Membership for the following Season. 9\. By agreeing to these Membership Terms and Conditions, each Member acknowledges and accepts that there may be a delay in the receipt of their Membership Benefits. Where applicable, Membership Benefits will be delivered to the address given by the Member at the time of purchase unless otherwise updated and notified to the Club. The Club cannot be held responsible if a Membership Benefit is delivered to the wrong address as a result of the Member or purchaser failing to notify the Club of a change to their address. 10\. Except as set out above, Memberships are non-refundable and non-transferable. Types of Memberships 11\. For the 2024/2025 Season, the following Memberships will be available for purchase from the Club: a) Longside Membership – standard package available to individuals aged 18 or over on 12th September 2024; and b) Junior Membership – standard package available to individuals under the age of 18 on 12th September 2024. 12\. These Membership Terms and Conditions, and the Membership Benefits set out in these Membership Terms and Conditions, **do not apply** to the Clarets Advantage Scheme. 13\. If during the course of the Season, a Junior Member turns 18, such Member shall continue with their current Junior Membership (and continue to be entitled to the same Membership Benefits associated with that Membership) until the next relevant Membership renewal date, at which time the Member will be upgraded to the Longside Membership or equivalent standard adult membership package and charged accordingly. 14\. Where a Junior Membership is purchased by someone other than the parent or legal guardian of the child, the purchaser may be required to provide the email details of the Junior Member’s parent or legal guardian. If the parent or legal guardian of a Junior Member objects to the purchase of a Junior Membership for their child, they should contact the Club within 14 days of purchase via the methods set out in section 27 below and request that the Junior Membership be cancelled. Upon cancellation in accordance with this section 14 only, a full refund shall be given to the purchaser using the payment details provided on purchase. 15\. If a Member is under the age of 18, their parent(s) or legal guardian(s) and/or Membership purchaser (as applicable) shall, in addition to the Member, be responsible for the Member’s actions, conduct and compliance with these Membership Terms and Conditions. Should any Member under the age of 18 breach these Membership Terms and Conditions, the Club shall be entitled to impose on the Member and/or their parent(s) and/or legal guardian(s) and/or Membership purchaser (as applicable) such sanction(s) as it considers appropriate in the circumstances. Price and Payment 16\. The price payable for each Membership for the Season shall be as set out on the official Club website or as otherwise notified by the Club from time to time. Prices for each Membership each Season or within a Season may be subject to change. Prices are inclusive of VAT, postage and packaging costs and transaction fees, where applicable. 17\. The Club always tries to ensure that the pricing information provided by the Club is correct, but errors may occur. Upon the Club becoming aware of any pricing or product description error in relation to any Membership which has been sold, the Club will endeavour to inform the purchaser as soon as reasonably practicable using the contact details provided to the Club. The Club will then provide the purchaser with the option of reconfirming the order at the correct price/product description or cancelling the order. If the Club is unable to contact the purchaser having made reasonable attempts to do so, the Club will treat the order as cancelled. If the order is cancelled or treated as cancelled, the Club will provide a full refund to the purchaser using the payment details provided. If valid payment details have not been provided, no further action will be taken by the Club. Membership Benefits 18\. For the 2024/25 Season, the Membership Benefits are: Longside Membership only a) Welcome Pack including a tote bag in a colour as chosen by the Longside Member and a limited-edition Burnley FC cap b) Entry into a ballot to win two (2) complimentary passes to an open training session c) Longside Member’s name to feature on the ‘Naming Wall’ to be located at Turf Moor for one (1) year (this Membership Benefit is only available to Longside Members who purchase their Membership on or before 31st December 2024) d) Automatic entry into a prize of the month draw\* e) Monthly match magazine to be delivered digitally once per month f) A welcome letter from Scott Parker g) 10% discount on any purchase made in person at the Clarets Shop (excluding sale items) h) One (1) 30% discount on stadium tour i) 20% discount when you purchase a Jimmy McIlroy hospitality package (applies to packages for up to 6 people only) j) Invites to Member-only events k) Access to offers and experiences through Burnley FC partners Junior Membership only a) Welcome Pack with choice of gift customised with the Junior Member’s favourite Club player and a Members-only Club sticker pack b) Entry into a ballot to win two (2) complimentary passes to meet-and-greets c) Junior Member’s name to feature on the ‘Naming Wall’ to be located at Turf Moor for one (1) year (this Membership Benefit is only available to Junior Members who purchase their Membership on or before 31st December 2024) d) Automatic entry into a prize of the month draw\* e) Monthly match magazine to be delivered digitally once per month f) A welcome letter from Scott Parker g) One (1) complimentary stadium tour junior pass when a full price stadium tour pass is purchased by an accompanying adult h) 20% discount when you purchase any Jimmy McIlroy suite junior package i) Invites to Member-only events j) Access to offers and experiences through Burnley FC partners *\* separate terms and conditions will apply* 19\. All Membership Benefits are subject to availability and applicable law and may be substituted for alternative Membership Benefits at any time at the Club’s sole discretion. 20\. If your Membership has automatically renewed in accordance with section 8 of these Membership Terms and Conditions, the Membership Benefits for the Season in question will be published on the Club’s website. Termination of Memberships 21\. The Club may terminate a Membership immediately on written notice and without a refund if the Member: a) breaches these Membership Terms and Conditions; or b) acts in a manner which is inconsistent with the applicable laws, statutes or regulations or if there are reasonable grounds for suspecting fraud, theft or dishonesty in connection with the Membership. 22\. Where the Club reasonably believes that any Member has breached any of these Membership Terms and Conditions then, in addition to any other right or remedy available to the Club, the Club reserves the right to impose any sanction it considers appropriate in the circumstances, which may include, without limitation, suspension or withdrawal of the Membership without reimbursement and/or the removal of any Membership Benefits. 23\. In the event that a Membership is terminated or withdrawn by the Club, the Club reserves the right to exclude the relevant Member from applying for any future Membership maintained or organised by the Club. Exclusion of Liability 24\. Except where stated otherwise in these Membership Terms and Conditions, the Club excludes all liability resulting from: a) any failure or delay by the Club in carrying out its obligations under these Membership Terms and Conditions which is caused by circumstances outside the reasonable control of the Club; b) any information provided by a third party; c) any failure by a Member or purchaser to provide updated contact/payment information details; and d) any failure to obtain a Membership or Membership Benefit due to the acts or omissions of any third party (including any postal service provider). 25\. The Club shall have no liability whatsoever for: a) any non-delivery, late delivery or technical fault of any Membership Benefit, document or other material dispatched and/or issued by the Club to the Member; b) any indirect or consequential loss or damage of whatever nature; or c) any loss of enjoyment; d) any losses arising from a Membership being used for commercial purposes (i.e. where the Membership is not being purchased and used by a consumer). 26\. For the avoidance of doubt, nothing in these Membership Terms and Conditions shall exclude or limit the Club’s liability for: a) death or personal injury caused by the negligence of the Club or its employees during the course of their employment; b) fraud or fraudulent misrepresentation by the Club; or c) any liability which may not be excluded or limited as a matter of law. The Club shall only process the personal data of any purchaser or Member as set out in the Club’s privacy notice or in accordance with applicable data protection law. 29\. The Club reserves the right to make changes to these Membership Terms and Conditions from time to time, and shall notify you of such changes if they materially affect your rights as a consumer. Any variations will be advertised on the Club’s website. 30\. The invalidity or partial invalidity of any provision of these Membership Terms and Conditions shall not prejudice or affect the remainder of these Membership Terms and Conditions, which shall continue in full force and effect. If any invalid, unenforceable or illegal provision of this agreement would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable. 31\. The Club’s failure to exercise, or delay in exercising, any right, power or remedy provided by these Membership Terms and Conditions or by law shall not constitute a waiver of that right, power or remedy. 32\. No person other than the purchaser, the Member or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Membership Terms and Conditions. 33\. These Membership Terms and Conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
